Can You Travel Abroad While Your Turkish Citizenship Application Is Pending? Security Checks, Delays and Legal Remedies

Applying for Turkish citizenship is an important decision, particularly for foreign investors, business owners and families planning to establish a long-term connection with Türkiye. But submitting the application is not necessarily the end of the process. For many applicants, the waiting period brings a different set of questions.
Can you leave Türkiye while your citizenship application is being processed? Will travelling abroad affect your security investigation? What happens if your application remains at the same stage for several months? And if the authorities reject your application, can you challenge their decision?
These are questions we regularly encounter when advising international clients at Kurucuk & Associates, an Istanbul-based Turkish law firm representing foreign nationals in citizenship, immigration and administrative law matters.
The answers depend largely on the legal basis of your application. A foreign investor applying through exceptional citizenship does not necessarily have the same residence obligations as someone seeking citizenship after five years of residence. Similarly, an application awaiting a security assessment raises different considerations from one awaiting routine document verification.
Understanding these differences before travelling, changing your residence arrangements or taking further action can help you avoid unnecessary complications.
In this article, we explain how Turkish citizenship security investigations work, what applicants should know about travelling abroad, how a Power of Attorney can help, and what legal options may be available when an application is delayed or rejected.
1. Understanding the Turkish Citizenship Application Process
Turkish citizenship can be acquired through several legal routes. For foreign nationals, two commonly used options are citizenship by investment and general naturalization following five years of qualifying residence.
Although both routes involve an assessment of national security and public order, the eligibility requirements are different.
Turkish citizenship by investment under Article 12
Foreign investors may qualify for exceptional Turkish citizenship under Article 12(1)(b) of Turkish Citizenship Law No. 5901, provided they satisfy the applicable investment conditions and receive the required approvals.
Qualifying investment categories include:
Purchasing real estate that meets the applicable minimum value and holding requirements.
Making a qualifying fixed-capital investment.
Depositing the required amount in a Turkish bank.
Purchasing eligible government debt instruments.
Investing in qualifying real estate investment or venture capital investment funds.
Creating employment in accordance with the applicable statutory requirements.
Each investment category has its own conditions, documentation requirements and competent authorities responsible for confirming eligibility.
One point deserves particular attention: completing a qualifying investment does not automatically make someone a Turkish citizen. The applicant must still satisfy the relevant legal requirements, including the absence of an obstacle concerning national security and public order.
For investors, this means that the citizenship process involves more than completing a property transaction or transferring the required investment amount. The application must also progress through the relevant administrative procedures.
Turkish citizenship through five-year residence under Article 11
Foreign nationals may also apply for Turkish citizenship through general naturalization after completing five years of qualifying uninterrupted residence in Türkiye.
Article 11 of Law No. 5901 sets out several requirements, including:
Being an adult with legal capacity.
Having resided uninterruptedly in Türkiye for five years immediately preceding the application.
Demonstrating an intention to settle in Türkiye.
Having good moral character.
Having sufficient knowledge of the Turkish language.
Having sufficient income or a profession to support oneself and dependent family members.
Not presenting an obstacle in terms of national security or public order.
Completing five years of residence is therefore only one part of the assessment. The authorities also consider the applicant's other circumstances and whether the statutory conditions have been fulfilled.
Why does the distinction matter?
Because the rules governing travel and residence are not identical for investment applicants and those applying through general naturalization. Understanding which provision applies to your application is the first step towards making informed decisions during the waiting period.
Official legislation: Turkish Citizenship Law No. 5901.
2. What Is the Turkish Citizenship Security Investigation (Güvenlik Soruşturması)?
One of the most important stages of a Turkish citizenship application is the security and background assessment, commonly referred to as Güvenlik Soruşturması.
Applicants sometimes assume that once their investment has been approved or their residence documents have been accepted, the remaining process is largely administrative. However, Turkish citizenship law also requires the authorities to consider whether the applicant presents an obstacle in terms of national security or public order.
This assessment can involve information from different public institutions, depending on the legal framework and circumstances of the individual application.
Which authorities may be involved?
The General Directorate of Security (Emniyet Genel Müdürlüğü) and the National Intelligence Organization (Millî İstihbarat Teşkilatı – MİT) are among the institutions associated with security-related assessments.
Provincial administrations and citizenship authorities also have important responsibilities in processing applications and coordinating relevant administrative procedures.
The precise institutional involvement may differ according to the application and the inquiries considered necessary.
What do the authorities examine?
There is no publicly available universal checklist that explains every aspect of every applicant's security investigation. Nevertheless, relevant considerations may include:
Identity and personal information verification.
Criminal convictions and relevant law-enforcement records.
Pending investigations or prosecutions where legally relevant.
Security-related records and restrictions.
Immigration history, including relevant visa violations or overstays.
Consistency and authenticity of submitted documents.
Information relevant to national security and public order.
For investment-based applications, the underlying investment must also satisfy the applicable legal requirements. The relevant authorities may request additional evidence to verify ownership, financial transactions or compliance with investment conditions.
It is important not to assume that every applicant undergoes precisely the same international database searches or financial investigations. The scope of an investigation depends on the applicable legal framework and the circumstances of the particular case.
Does Law No. 7315 govern Turkish citizenship security investigations?
Law No. 7315, known as the Security Investigation and Archive Research Law (Güvenlik Soruşturması ve Arşiv Araştırması Kanunu), regulates security investigations and archive research within its defined statutory scope.
Articles 4, 5 and 6 address relevant records, investigative procedures and competent institutions.
However, it would be inaccurate to suggest that every provision of Law No. 7315 automatically applies to every foreign national's citizenship application.
The principal citizenship requirements are established by Law No. 5901, particularly Articles 11 and 12, together with the applicable citizenship regulations.
For applicants concerned about a security-related delay or an adverse decision, identifying the correct legal basis is essential.
How long does the security investigation take?
This is understandably one of the first questions applicants ask us.
Unfortunately, there is no single statutory processing period that guarantees completion of every citizenship security investigation within a particular number of days.
Some applications progress relatively smoothly, while others take considerably longer. The timeline may depend on:
The applicant's citizenship route.
The completeness of the submitted documents.
The need for additional institutional inquiries.
Verification of foreign records and documents.
The applicant's individual circumstances.
The workload of the relevant administrative authorities.
A particularly frustrating situation arises when an applicant checks the online tracking system repeatedly but sees no change in the application status.
This does not necessarily mean that the application has been rejected or that the security investigation has produced an adverse result.
The administration may still be awaiting information, reviewing records or completing internal procedures that are not reflected in the public tracking system.
At Kurucuk & Associates, we approach these situations by examining the actual application history rather than making assumptions based on an unchanged online status. Where appropriate, we advise clients on formal enquiries, administrative petitions and other available legal steps.
3. Can You Travel Abroad While Your Turkish Citizenship Application Is Pending?
This is perhaps the most practical concern for foreign nationals who have work, family or business commitments outside Türkiye.
The good news is that leaving Türkiye does not automatically invalidate every pending citizenship application.
However, the legal consequences of travelling depend on the route through which citizenship is being sought.
A. Travelling while applying for citizenship by investment
Foreign nationals applying through exceptional citizenship under Article 12 generally do not have to complete the five-year uninterrupted residence period required under Article 11.
For this reason, the twelve-month cumulative absence rule under Article 15 should not automatically be treated as a travel restriction on investment applicants.
In general, an investment applicant may travel abroad while the citizenship application is pending, provided that:
The qualifying investment remains compliant with the applicable conditions.
Any required investment holding period is maintained.
The applicant continues to comply with applicable immigration requirements.
No separate legal restriction prevents departure or re-entry.
The applicant remains available for procedures requiring personal attendance.
Does leaving Türkiye cancel an investment-based citizenship application?
No. Temporary travel abroad does not, by itself, automatically cancel a properly submitted investment-based citizenship application.
Nevertheless, citizenship eligibility and immigration status are separate legal matters.
For example, if an applicant holds a Turkish residence permit connected with the investment, its validity, renewal requirements and re-entry conditions must be considered separately.
At Kurucuk & Associates, we advise investors to examine these matters before making extended travel arrangements, particularly where the application is still awaiting an administrative or security assessment.
B. Travelling while applying through five-year residence
The position is different for applicants relying on general naturalization under Article 11.
Article 11 requires five years of uninterrupted residence in Türkiye immediately preceding the application.
Article 15 of Law No. 5901 provides that an applicant may spend a total of up to twelve months outside Türkiye during the qualifying residence period.
This is a cumulative limit rather than a separate twelve-month allowance for each year.
Consider the following example:
Year | Time spent outside Türkiye |
First year | 2 months |
Second year | 3 months |
Third year | 1 month |
Fourth year | 2 months |
Fifth year | 3 months |
Total | 11 months |
In this example, the cumulative absence is within the statutory twelve-month limit, subject to the other applicable requirements.
If the cumulative absence exceeds twelve months, the applicant may encounter difficulties establishing the qualifying residence period.
One important clarification: this calculation concerns the five-year residence period preceding the citizenship application. It should not automatically be treated as a new twelve-month limit applicable to every subsequent year of the application's pending period.
Nevertheless, prolonged overseas stays after filing can still raise questions about the applicant's intention to settle in Türkiye, immigration status and individual circumstances.
C. What if you need to travel during the pending application?
A short business trip, family visit or holiday does not necessarily create a citizenship problem.
The important thing is to understand the nature of your application and avoid circumstances that could undermine your eligibility.
Before travelling, consider:
Whether your five-year qualifying residence period has already been established.
Whether your previous absences have been calculated correctly.
Whether your residence permit remains valid.
Whether you have any upcoming interview or personal attendance requirement.
Whether your travel arrangements could affect your intention to settle in Türkiye.
Keeping copies of entry and exit records is also sensible, particularly for applicants whose eligibility depends on a continuous residence history.
Our lawyers at Kurucuk & Associates can review an applicant's travel history and immigration documents before departure, helping identify potential issues rather than addressing them after a problem arises.
D. What happens if your residence permit expires or is cancelled?
A pending citizenship application does not automatically extend an existing residence permit.
This is an important point that applicants sometimes overlook.
Your citizenship application and your right to reside in Türkiye are governed by separate legal procedures. Submitting a citizenship application does not necessarily give you a new or extended immigration status.
You should therefore monitor:
Your residence permit's expiry date.
Any applicable extension requirements.
Whether a cancellation or non-renewal decision has been issued.
Your right to remain in Türkiye while an extension application is pending.
Your ability to leave and subsequently re-enter Türkiye.
Article 24 of Law No. 6458 on Foreigners and International Protection addresses residence permit extensions and the relevant application procedures.
Official information: Presidency of Migration Management – Residence Permits.
4. Can a Lawyer Handle Your Turkish Citizenship Application Through a Power of Attorney?
Not every applicant can remain in Türkiye throughout the citizenship process. Foreign investors, business owners and families often have commitments in other countries.
This is where proper legal representation becomes particularly useful.
A suitably drafted Power of Attorney (Vekâletname) allows an authorized lawyer to handle many administrative procedures without requiring the applicant to attend every appointment personally.
Can citizenship applications be submitted through a Power of Attorney?
Yes, subject to the applicable requirements.
Article 37 of Law No. 5901 recognizes applications made personally or through a Power of Attorney specifically authorizing the exercise of citizenship-related rights.
However, certain procedures require the applicant's personal attendance.
According to the published guidance of the Directorate General of Population and Citizenship Affairs:
Where fingerprinting is mandatory, the applicant must attend personally.
Where fingerprinting is not required, certain applications may be submitted through an authorized representative.
Subsequent administrative procedures, including submission of missing documents, may generally be handled personally or through an attorney.
Official reference: Turkish Directorate General of Population and Citizenship Affairs – Citizenship FAQs.
Can fingerprints or biometrics be completed at a Turkish consulate abroad?
This is another question that requires individual confirmation.
Turkish diplomatic missions provide certain citizenship-related services abroad, but applicants should not assume that every biometric requirement arising during a domestic citizenship application can be completed at any Turkish consulate.
The relevant citizenship authority and the Turkish foreign mission should be consulted before making arrangements.
Travelling abroad on the assumption that a pending fingerprinting requirement can automatically be completed through a consulate may result in unnecessary complications.
What should your Power of Attorney authorize?
A carefully prepared Power of Attorney can allow your lawyer to undertake a range of citizenship-related administrative tasks.
Depending on the individual case, it may include authority to:
Represent you before the Directorate General of Population and Citizenship Affairs.
Communicate with provincial citizenship directorates.
Submit petitions, supporting documents and declarations.
Obtain available information about your application.
Respond to requests for missing documentation.
Receive administrative notifications where legally permitted.
Submit appropriate administrative objections.
Initiate judicial proceedings where specifically authorized and legally appropriate.
The document must be prepared in accordance with Turkish legal requirements.
Where the Power of Attorney is executed abroad, the applicable notarization, apostille or consular authentication and sworn translation requirements must also be considered.
At Kurucuk & Associates, we pay particular attention to the wording and scope of the Power of Attorney so that our clients receive effective legal representation throughout the procedures that can lawfully be handled by an attorney.
5. What Can You Do If Your Turkish Citizenship Application Is Delayed?
Waiting for a citizenship decision can be particularly difficult when there is no clear explanation for the delay.
An applicant may have completed the investment, maintained the necessary documents and fulfilled the relevant requirements, yet still have no meaningful update.
Rather than repeatedly checking the online tracking system, it may be more productive to examine the administrative history and determine whether a formal legal request is appropriate.
A. Request information about the application
An initial step may involve submitting a formal petition to the competent citizenship authority.
Depending on the circumstances, the request can seek clarification about:
The current procedural stage.
Whether any documents remain outstanding.
Whether the file is awaiting information from another institution.
Whether additional explanations are required.
Whether any further administrative action is necessary.
The purpose is not simply to ask why an application is taking so long. It is to establish the procedural position and identify whether there is an appropriate next step.
B. Making a formal administrative application under Article 10 of Law No. 2577
Turkish Administrative Judicial Procedure Law No. 2577 provides a mechanism for individuals to request an administrative act or action from the relevant authority.
Article 10 is particularly important where an individual seeks an administrative decision that could be the subject of judicial proceedings.
Under the current provision, where the administration does not respond within thirty days, the request is generally deemed rejected for the purposes of the relevant administrative procedure.
However, this does not mean that every pending citizenship application is automatically rejected after thirty days.
The legal effect depends on the nature of the request, the applicable procedure and the circumstances of the case.
An experienced administrative lawyer can assess whether Article 10 is appropriate and how any subsequent judicial deadline should be calculated.
C. Can you take legal action against unreasonable delays?
In appropriate circumstances, administrative inaction or an unreasonable delay may justify judicial proceedings.
The available legal route depends on what the administration has or has not done and the relief being sought.
Potential legal issues may include:
Failure to respond to a formal administrative application.
Failure to take an administrative decision within a legally reasonable period.
Failure to comply with applicable procedural requirements.
Unlawful administrative inaction.
Violation of relevant procedural rights.
It is important to understand that taking a matter to court does not automatically mean citizenship will be granted.
The administrative court examines the legality of the administrative conduct within its jurisdiction. The citizenship authority retains its statutory responsibilities concerning eligibility, national security and public order.
At Kurucuk & Associates, we assess the available procedural history before recommending litigation. In some cases, a carefully prepared administrative petition may be the appropriate first step; in others, judicial proceedings may need to be considered.
D. What if your Turkish citizenship application is rejected?
Receiving a rejection decision can be disappointing, particularly after completing an investment or spending several years meeting residence requirements.
However, a rejection should not be treated as the end of the matter without first examining its legal basis.
The decision and available administrative records should be reviewed to determine whether there are grounds for challenge.
Potential issues may include:
Incorrect factual findings.
Failure to consider relevant evidence.
Misinterpretation of citizenship legislation.
Procedural irregularities.
Inadequate legal reasoning.
Reliance on inaccurate or outdated information.
Failure to comply with applicable legal safeguards.
Under Article 7 of Law No. 2577, the general period for bringing an action before an administrative court is sixty days from notification of the administrative act, subject to any applicable special provisions.
The relevant deadline must be calculated carefully. Applicants should not assume that informal correspondence or an unanswered request automatically suspends the judicial time limit.
E. Can an adverse security-related decision be challenged?
Yes, an adverse citizenship decision may be subject to judicial review where the relevant legal conditions are satisfied.
However, these cases can be particularly complex because the underlying information may involve confidential security material or information that cannot be disclosed without legal restrictions.
The legal assessment may consider:
Whether the decision has a lawful basis.
Whether the information relied upon is relevant to the statutory requirements.
Whether the applicant's individual circumstances have been properly considered.
Whether the administration has complied with applicable procedural safeguards.
Whether there are inaccuracies or outdated records.
Whether the decision is consistent with relevant constitutional protections.
Article 20 of the Turkish Constitution protects privacy and personal data. Law No. 6698 on the Protection of Personal Data (KVKK) may also be relevant, depending on the nature of the information and applicable exemptions.
For this reason, applicants should seek legal advice before making assumptions about the reasons behind an adverse security assessment.
6. Practical Advice for Applicants Waiting for Turkish Citizenship
Whether you are applying through investment or five-year residence, a little preparation can prevent avoidable difficulties during the waiting period.
At Kurucuk & Associates, we encourage applicants to treat the post-application period as an important part of the citizenship process, not simply a period in which nothing needs to be done.
Consider the following checklist:
Keep copies of your complete citizenship application.
Retain your application and reference numbers.
Monitor your passport and residence permit validity.
Maintain records of international travel.
Keep investment-related documents available where applicable.
Respond promptly to official requests.
Ensure that your Power of Attorney covers the necessary procedures.
Attend any mandatory biometric appointments or interviews.
Obtain clarification before making extended travel arrangements.
Seek legal advice promptly if you receive an adverse decision.
Most importantly, remember that the appropriate approach depends on your individual circumstances.
An investment applicant who wishes to spend several months abroad may have a different legal position from a naturalization applicant whose residence history is central to citizenship eligibility.
Similarly, an application awaiting routine verification requires a different response from one that has received a formal rejection.

Make Informed Decisions While Your Turkish Citizenship Application Is Pending
A pending Turkish citizenship application does not necessarily mean that you must remain in Türkiye throughout the entire waiting period. However, travelling abroad, maintaining a residence permit and responding to security-related inquiries all require an understanding of the legal route under which you are applying.
Investment applicants under Article 12 generally have greater flexibility regarding travel than applicants seeking citizenship through five-year naturalization. The latter must carefully satisfy the cumulative absence requirements under Article 15 when establishing their qualifying residence period.
Likewise, a delay in the security investigation does not automatically mean that an application will be rejected. The right response depends on the actual administrative circumstances, the documents submitted and whether the authorities have taken a formal decision.
Where delays become unreasonable or a rejection appears legally questionable, Turkish administrative law may provide avenues for seeking appropriate relief.
At Kurucuk & Associates, we believe that every citizenship application deserves careful legal attention, clear communication and an approach based on the applicant's actual circumstances.
